Terms of Service

1. Acceptance of Terms
By accessing or using Bench ("the Service"), operated by Bench ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Service Description
Bench is a cloud-based repair shop management platform that provides tools for work order intake, repair tracking, customer communication, invoicing, and payment processing. The Service is designed for businesses that perform repair services.
3. Account Terms
- You must be at least 18 years old to use the Service.
- You must provide accurate and complete registration information.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- One person or legal entity may maintain no more than one free trial account.
- You must notify us immediately of any unauthorized use of your account.
4. Subscription & Payment
Free Trial
New accounts receive a 14-day free trial with full access to all features. No credit card is required to start a trial. At the end of the trial, you must subscribe to a paid plan to continue using the Service.
Billing
- Subscriptions are billed monthly or annually, depending on the plan you select.
- All fees are exclusive of taxes, which will be added where applicable.
- Payment is processed securely through Stripe. By subscribing, you also agree to Stripe's Terms of Service.
Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not provide prorated refunds for partial billing periods.
5. SMS/Text Messaging Terms
Bench and its customer repair shops use SMS (text messaging) to send repair status updates and notifications to end customers.
Consent
By providing your phone number during repair intake — whether in-store, via a drop-off form, or through a mail-in request — and agreeing to receive text message updates, you consent to receive SMS messages from Bench on behalf of the repair shop servicing your equipment. Consent is not a condition of service.
Message Types
You may receive the following types of text messages:
- Repair intake confirmations
- Estimate approvals and updates
- Repair status changes (in progress, complete, ready for pickup)
- Invoice and payment notifications
- Pickup reminders
- Feedback and review requests
Message Frequency
Message frequency varies based on repair activity. You will typically receive 2-6 messages per repair order.
Opt-Out
You can opt out of SMS messages at any time by replying STOP to any message. You will receive a confirmation that you have been unsubscribed. After opting out, you will no longer receive text messages from Bench. You may opt back in by replying START.

Rates
Message and data rates may apply. Bench does not charge for SMS messages, but your mobile carrier's standard messaging rates may apply.
Carriers
SMS messages are supported on all major U.S. carriers including AT&T, T-Mobile, Verizon, and others. Carriers are not liable for delayed or undelivered messages.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to the Service or its related systems
- Interfere with or disrupt the integrity or performance of the Service
- Upload or transmit viruses, malware, or other malicious code
- Use the Service to send unsolicited communications (spam)
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Resell, sublicense, or redistribute the Service without our written consent
7. Intellectual Property
The Service, including its design, code, features, and documentation, is owned by Bench and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your business operations.
8. Data Ownership
You retain full ownership of all data you enter into the Service ("Your Data"), including customer information, work orders, invoices, and business records. We do not claim ownership of Your Data.
You grant us a limited license to use Your Data solely to provide and improve the Service. We will not access Your Data except as necessary to operate the Service, provide support, or comply with legal obligations.
You may export Your Data at any time. Upon account termination, we will delete Your Data within 90 days unless retention is required by law.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.
10. Termination
We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or engage in activity that harms the Service or other users. You may terminate your account at any time by contacting us or using the account settings.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BENCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
13. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in New York County, New York.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
